State and Law
The Republic of Belarus is a unitary democratic social constitutional state. President is the head of the state. The rights, duties and status of the President of the Republic of Belarus are regulated by the Constitution of the Republic of Belarus, the law "On the President of the Republic of Belarus" and other legislative acts. The state power in the Republic of Belarus is exercised on the principle of its separation into legislative, executive, and judicial powers:
The Legislative branch is represented by bicameral Parliament – the National Assembly:- upper chamber – Sovet Respubliki (Council of the Republic);
- lower chamber – House of Representatives;
- Constitutional Court;
- System of Courts of General Jurisdiction:
- Supreme Court of the Republic of Belarus;
- Regional (Minsk city) courts;
- Economic courts of regions (city of Minsk);
- District (city) courts.
The Executive Power is represented by the Government – Council of Ministers of the Republic of Belarus, headed by the Prime Minister. The Prime Minister is appointed by the President with the consent of lower chamber of Parliament. The Government in its activity reports to the President of the Republic of Belarus. The President has right on his own initiative to make resolution on resignation of the Government and to remove any member of the Government from his/her position.
The Legislative Power is based on the principles of territoriality and specialization It consists of:
The Legislative Power is exercised by means of constitutional, civil, criminal, commercial and administrative procedures.State bodies are independent within their powers. They cooperate with each other, restrain and balance each other.
The system of state authorities of the country includes:
• The President of the Republic of Belarus (The Head of State);
• Parliament ( National Assembly of the Republic of Belarus: The Council of the Republic and the House of Representatives of the National Assembly of the Republic of Belarus);
• Government (the Council of Ministers of the Republic of Belarus);
• Courts;
• Prosecutor General’s Office of the Republic of Belarus;
• The State Control Committee of the Republic of Belarus;
• Institutions of local government and self-government.
The people are the only source of state power in the Republic of Belarus. The power is exercised by representative and other state bodies, as well as in the forms and within the limits laid down by the Constitution of the country.
The state, all its bodies and officials are acting within the Constitution of the Republic of Belarus and other legislative acts adopted in accordance with it. Thus, the principle of the rule of law is affirmed and implemented.
The individual, his/her rights, freedoms and guarantees to secure them are the supreme value and goal of the society and the State in the Republic of Belarus.
